Terms of Use

These Terms of Use (the "Terms") govern your access to and use of Infinex AI (the "Service") operated from infinexai.io. By creating an account or using the Service you agree to these Terms.

1. What the Service does

Infinex AI is a SaaS platform that generates motion graphics, AI-narrated avatar videos, voice clones, and short-form video content from a single text prompt. The platform combines several third-party AI providers (Anthropic, HeyGen, fal.ai) with a rendering pipeline (Remotion) and media hosting (Cloudinary) to produce downloadable MP4 video files.

2. Your account

• You must be at least 18 years old (or the age of majority in your jurisdiction).
• You are responsible for the security of your account credentials. Do not share your password or refresh token.
• One account per person. Account sharing (multiple people using the same account) is not permitted.
• You may sign up with email + password or with Google Sign-In. Both methods are equally valid.
• We may suspend or terminate accounts that violate these Terms, with or without notice depending on severity.

3. Credits

• The Service uses a credit-based metering system. Each generation or render action consumes credits.
• Subscription plans (Starter / Pro / Business) refill credits monthly on the renewal date. Unused subscription credits do not roll over - they reset to the plan's allotment at renewal.
• Top-up credit packs (one-time purchases) persist until used. They do not expire while your account is active.
• Credits are non-transferable between accounts and have no cash value.
• If a generation fails due to an external service outage (e.g. HeyGen API is down), credits for that specific job are automatically refunded by our internal accounting.

4. Content you create

Ownership. You own the output of every generation you create. We claim no ownership over your prompts, your uploaded reference material, or the rendered videos. You can use the generated content for personal or commercial purposes.

License back to us. By using the Service, you grant us a non-exclusive, royalty-free license to store and process your content as needed to operate the platform (e.g. caching frames, transmitting to HeyGen for synthesis, returning the output to you). This license ends when you delete the content.

No watermark on paid content. Paid subscription output is delivered without a platform watermark.

5. Acceptable use

You agree NOT to use the Service to create or distribute:

• Deepfakes or impersonation - videos that depict identifiable real people without their consent. Custom avatars and voice clones must depict the requesting user themselves; HeyGen's own consent + identity-verification workflow enforces this for custom avatars and voice clones.
• Adult or sexually explicit content.
• Hate speech, harassment, or content inciting violence.
• Political deepfakes or disinformation - content designed to mislead viewers about real political figures, events, or policy positions.
• Content infringing third-party intellectual property - including trademarks, copyrighted images, and likenesses of celebrities or other identifiable people without rights to use them.
• Spam, phishing, or malware.
• Automated/bulk generation outside human-prompted use - reselling raw access to our APIs, scraping the Service, or running headless prompt-flooding scripts.
• Anything illegal under Israeli law or the law of your jurisdiction.

Violation of any of the above may result in immediate account suspension, deletion of generated content, and reporting to law enforcement where required. Repeated or severe violations forfeit any remaining credits and subscription rights without refund.

6. Third-party dependencies and availability

The Service depends on external AI providers (Anthropic, HeyGen, fal.ai) and infrastructure (Railway, Cloudinary, Polar.sh). If any of them experience an outage, the affected feature may be temporarily unavailable. We do not guarantee uptime and are not responsible for downtime caused by third-party provider failures. We will refund credits for jobs that fail because of an upstream outage.

7. Changes to the Service

We may add, modify, or remove features at any time. We may change pricing with at least 30 days' notice to existing subscribers, applied at the next renewal. Material changes will be announced via in-app notification or to your account email.

8. Termination

• You may terminate your account anytime via the customer portal. Your subscription stops at the end of the current billing period; no partial refunds for the unused portion.
• We may terminate accounts that violate Section 5 (Acceptable Use), repeatedly trigger payment chargebacks, or abuse the platform.
• Upon termination, your account data is deleted per our Privacy Policy. Generated content under retention TTLs is removed automatically.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. AI-generated output may occasionally contain errors, artifacts, or unexpected interpretations of your prompt. You are responsible for reviewing output before public use.

10. Limitation of liability

To the maximum extent permitted by law, Infinex AI's total liability for any claim arising from your use of the Service is limited to the total amount you paid us in the six (6) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.

11. Governing law and disputes

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the competent courts of Tel Aviv-Yafo, Israel. If you are a consumer in the EU/EEA, this clause does not deprive you of the protections of mandatory consumer-protection laws of your country of residence.
